End User License Agreement

By installing NinjaLoader you will get NinjaSurf as mandatory component of NinjaSurf (both NinjaLoader and NinjaSurf are referred to as ‘Software’ or ‘Application’) you agree to this End User License Agreement and apropriate Privacy Policy. Software is property of Click Yes LP (referred to as ‘Company’) We want to make our disclosure as clear as possible for you, and you will also always have a link to the End User License Agreement from within the installer when you first run it.

1. On each of our software pages it will specify the exact distribution license the specific software title uses. By installing this software you are agreeing to be bound by this End User License Agreement, and all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or installing the Software. The materials contained within the installer and software are protected by applicable copyright and trade mark law.
2. Information

NinjaSurf search for videos on other sites even when users do not use the software and automatic scanning of external websites.
Software looking audio and video files. And also allows the user to download them locally to your computer. All videos and mp3s taken from open sources available on the internet.
Performs automatic scanning for the presence of third-party sites and shapes our video server database with the data and data is transmitted to the server automatically.
Scans search engines and various websites to gather information about placing advertisements and collect statistics.
3. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Software for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials; use the materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer the application; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or “mirror” the materials on any other server. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Company at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
4. Privacy Policy

Information Click Yes LP receives when NinjaSurf runs on your computer.
You do not need to provide any Personal Information in order to download or use the Software.
Click Yes LP (“Click Yes ”) takes your privacy very seriously.
Information Click Yes Stores when NinjaSurf runs.
NinjaSurf stores some of your information locally on your system. For example, the NinjaSurf may store basic browsing history such as URL’s of pages is visited by NinjaSurf, text and images from those pages, IP addresses linked from the pages, index of most pages you visit, cookies deposited on your system by and a record of downloads you have made. All stored data will be automatically deleted after NinjaSurf session ends. Also, NinjaSurf will put unique identifier to your computer in order to track further NinjaSurf sessions.
Click Yes LP does not automatically collect any Personal Information on or through the Website, except as may be provided by you in connection with your voluntary communications with LP. However, when you visit the Website, Click Yes LP may automatically collect certain information about your computer to facilitate, evaluate and verify your use of the Website. For example, Click Yes LP may use “cookies”, “web beacons” and similar devices to track your activities as a visitor to the Website.
Software does not share any personal information nor does it follow the users.
Protecting the privacy of the very young is especially important. Click Yes LP operates its Website and Software in compliance with the Children’s Online Privacy Protection Act (COPPA). The Website and Software are not directed to individuals under the age of thirteen (13), and we request that such individuals do not provide any personally identifying information through the Website.
5. Disclaimer

The materials on Software are provided “as is”. The application makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, the Software does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on contained within the application. Company nor its subsidiaries do not held any responsibility of damage or loss or improper function may occur.
Software will use small amount of your computer RAM, CPU time and network bandwidth for volunteer website crawling. Amount of used resources are automatically adjusted to not impact your everyday computer experience.
6. Limitations

In no event shall Software or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials within the Application, even if an authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
7. Revisions and Errata

The materials appearing on Software could include technical, typographical, or photographic errors. Software does not warrant that any of the materials in the Application are accurate, complete, or current. Software can update their components, or completely updated in order to ensure stability and security, without notifying the user. Software may make changes to the materials contained in the Application at any time without notice. Software does not, however, make any commitment to update the materials.
8. Links

Software has not reviewed all of the sites linked within the Application and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Software of the site. Use of any such linked web site is at the user’s own risk.
9. End User License Agreement Modifications

Software may revise the Software End User License Agreement at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
10. Governing Law

Any claim relating to the Application shall be governed by the laws of India without regard to its conflict of law provisions. This End User License Agreement is applicable to Use of the Software Application
